Terms of Service
Never use TurboGrid while driving. TurboGrid is never a race: obey traffic laws and don't race on public roads. We have zero tolerance for objectionable content and abusive users.
1. These terms
These terms are an agreement between you and Artesia Labs LLC (“Artesia Labs”, “we”, “us”) about your use of TurboGrid: the apps, the service behind them and turbogrid.app. Our Privacy Policy explains how we handle your information. When you create an account, you confirm that you're 17 or older and agree to these terms and the Privacy Policy, by ticking the box on the sign-up screen. By using TurboGrid you agree to these terms too. If you don't agree, don't use TurboGrid.
2. Who can use TurboGrid
You must be at least 17 years old and live in the United States. One person per account. Give accurate information, keep your password private, and tell us if someone else gets into your account; you're responsible for what happens on it. You can't use TurboGrid if we have ended an account of yours for breaking these terms.
3. Safety comes first
3.1 Never use TurboGrid while driving. Don't look at, type in or play TurboGrid while you're driving. Park somewhere safe first. TurboGrid's minigames won't start while you're moving, but staying safe is up to you. If you're a passenger, don't distract the driver.
3.2 No street racing or reckless driving. TurboGrid is not a racing app and never rewards how fast you drive. Don't race, speed, do stunts, burnouts or drifts, or join “takeovers” or sideshows on public roads, and don't post or promote them. Obey traffic laws and speed limits.
3.3 Respect places and people. Waypoints and meets can be on or near private property. Follow posted rules, don't trespass, don't block traffic or entrances, and leave when asked. A waypoint on the map is not permission to be somewhere.
3.4 Meets. Meets are gatherings of players. We don't supervise them and aren't responsible for what happens at them. Use good judgment when meeting people you know from the app.
3.5 Map accuracy. Maps, places and locations in TurboGrid can be wrong or out of date. Don't rely on TurboGrid for navigation or safety.
4. Community rules: zero tolerance
We have zero tolerance for objectionable content and abusive users. Don't post, upload or send anything that:
- is sexually explicit, or sexualizes, exploits or endangers minors in any way (we report child sexual exploitation to the National Center for Missing & Exploited Children);
- harasses, bullies, threatens or intimidates anyone, or attacks people for their race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation or age;
- shows or encourages violence, self-harm, illegal activity, street racing or reckless driving;
- shares someone else's private information, such as where they live, a license plate tied to a person, a phone number or their exact whereabouts, or photos of people meant to harass them;
- impersonates a person, club or company, or misleads people;
- is spam, a scam or advertising we didn't allow;
- infringes someone's copyright, trademark or privacy.
Don't cheat: no faking your location (GPS spoofing), bots or automation, exploiting bugs, or using extra accounts to gain an advantage.
5. Reporting, blocking and enforcement
- Report anything that breaks these rules: use ⋯ → Report on a post, comment, event or photo, on a driver's profile, or on a club chat message by pressing and holding it. Reports go to our moderators.
- Block any player from the ⋯ menu on their posts, comments and photos, from their profile, or from their chat messages. You stop seeing each other's posts, comments, photos and chat messages and can't open each other's profiles in the app. They aren't told.
- We act on reports. Our moderators review reports and act on them within 24 hours. When content breaks these rules we remove it, and we can end the account that posted it.
- We may remove any content, and limit, suspend or end any account, at any time if we believe it breaks these terms or puts people at risk, with or without a report. When a moderator removes your content, we tell you in the app what was removed and why.
- To question a decision, email cal@artesialabs.dev.
6. Your content
You own what you post. You give Artesia Labs a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, format, display and distribute your content in order to run, improve and promote TurboGrid. The license ends when you or we delete the content, except for copies we keep as our Privacy Policy describes (for example moderation records) and copies other players already shared. You promise you have the rights to what you post, including permission from people who appear prominently in your photos. We don't claim ownership of your content. If you send us suggestions, we can use them freely.
7. Game progress and virtual items
XP, levels, influence, territories, rewards and other game items have no money value, can't be sold or transferred outside TurboGrid, and aren't your property. We may change, rebalance or reset them, for example at the end of a season. TurboGrid has no purchases. If we offer paid features later, extra terms will apply and payments will go through the App Store or Google Play.
8. Our app and trademarks
The TurboGrid name, its logos, art and software belong to Artesia Labs. We give you a personal, non-transferable, revocable license to use the app for your own non-commercial use. Don't copy, modify, reverse engineer, scrape, overload or interfere with TurboGrid, or access it except through our apps.
9. Other companies' services and brands
Maps come from Mapbox, MapTiler and OpenStreetMap contributors under their own terms. Car makes and models named by players belong to their owners; TurboGrid isn't affiliated with or endorsed by any vehicle manufacturer.
10. Ending your account
You can delete your account at any time in the app (Profile → Settings → Account → Delete account) or by email, as turbogrid.app/delete-account explains. We may suspend or end your account if you break these terms, or to protect players or TurboGrid. Sections 6 (for copies we keep), 7, and 12 to 15 continue after your account ends.
11. Changes to TurboGrid and these terms
We may change or stop features. When we change these terms, we'll update the version at the top and ask you to accept the new version in the app before you keep playing.
12. Disclaimers
TurboGrid is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement, and we don't promise that TurboGrid, its maps or its locations will be accurate, safe, uninterrupted or error-free.
13. Limitation of liability
To the extent the law allows, Artesia Labs won't be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, and our total liability for any claim about TurboGrid is limited to the greater of US$50 or the amount you paid us in the 12 months before the claim. Some states don't allow these limits, so they may not apply to you.
14. Indemnity
If your content or your breach of these terms leads to a claim against us, you'll cover our reasonable costs and losses from it, to the extent the law allows.
15. Disputes
These terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute will be decided in the state or federal courts in Utah County, Utah, and you and we consent to their jurisdiction, except that either of us may bring an individual claim in small-claims court.
16. Copyright complaints
If you believe content on TurboGrid infringes your copyright, send a notice to our designated agent: Copyright Agent, Artesia Labs LLC, 594 S 754 W, Orem, UT 84058, cal@artesialabs.dev. Under the Digital Millennium Copyright Act, the notice must include:
- your physical or electronic signature;
- the work you believe is infringed;
- the content you believe infringes it, and where it is in TurboGrid;
- your name, address, phone number and email address;
- a statement that you believe in good faith that the use isn't authorized by the owner, its agent or the law;
- a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.
If we remove your content after a notice and you believe that was a mistake, you can send us a counter-notice. We end the accounts of repeat infringers.
17. App store terms
If you downloaded TurboGrid from Apple's App Store:
- these terms are between you and Artesia Labs only, not Apple, and Artesia Labs, not Apple, is responsible for TurboGrid and its content;
- your license is limited to use on Apple-branded products you own or control, as the App Store's Usage Rules allow;
- Apple has no obligation to provide maintenance or support for TurboGrid;
- if TurboGrid fails to meet a warranty that applies, you may notify Apple and Apple will refund any price you paid for it; Apple has no other warranty obligation;
- Artesia Labs, not Apple, is responsible for any product, legal or consumer-protection claims about TurboGrid, and for investigating and resolving any claim that TurboGrid infringes someone's intellectual property;
- you confirm you're not in a country under a US government embargo or designated as “terrorist supporting”, and you're not on any US government list of prohibited or restricted parties;
- you must follow applicable third-party terms, such as your mobile carrier's, when using TurboGrid;
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If you downloaded TurboGrid from Google Play, Google Play's terms also apply to your download.
